2. Locate and use a program authorized list of consumer rights to reference or share with others

3. Understand and follow specific guidelines regarding the treatment of consumers within their care

4. Understand the legal obligations concerning insuring consumer rights

"For those of you who have chosen to provide care for others, something extra is expected. Not only will you be looking out for the physical needs of these individuals but also for their personal well-being. This will always include ensuring their protection under the law...

As far back as the early 1970s, the parents and families of persons who had been placed in institutional settings began to put pressure on their federal representatives to enact laws for the protection of their loved ones. As we study these laws, you'll see that they go a long way toward preventing abuse and neglect. It was a fact, that prior to this time, individuals living in most of these places were not well cared for. Often they were not cleaned up or dressed properly, their possessions were stolen, they were subject to experimentation, and physically restrained against their will. Few care providers seemed concerned since these people were considered social outcasts..."

"...The "Bill of Rights" section of the Act states that it is the government's policy to encourage states to provide appropriate services and habilitation to people with developmental disabilities. ("Habilitation" means the education, treatment, and training that allows developmentally disabled people to achieve their maximum potential.) Treatment should maximize the developmental potential of an individual and should be provided in the least restrictive setting possible. (42 U.S.C. § 6000.)..."

Each person with a developmental disability has the same rights, protections, and responsibilities as all other persons under the laws of each state and under the laws and Constitution of the United States. Unless otherwise restricted by law, any person with a developmental disability may exercise these rights, at will. The following is a listing of personal rights provided to persons with disabilities. These rights include, but are not limited to:

(a) A right to treatment and habilitation services. Treatment and habilitation services shall foster the developmental potential of the person. Such services shall protect the personal liberty of the individual and shall be provided under conditions, which are the least restrictive necessary to achieve the purposes of treatment.

(b) A right to dignity, privacy, and humane care.

(c) A right to participate in an appropriate program of publicly supported education, regardless of the degree of handicap...

"...As has been said before, most of your consumers will not have a clear idea, if any idea at all, what their personal rights might be. Their quality of life will be directly affected by your ability to teach this information to some, but to others, you will need to provide opportunities for them to exercise these rights, regardless of their level of understanding.
